Terms of Use

These End User Terms of Use ("Use Terms" or "TOU") govern the use of the TrendMD content recommendation widget (as defined below) and related services by any individual who views or interacts with content promoted via the Widget ("User" or "you"). TrendMD LLC (referred to as the "Company," "we," "us," or "our") provides the Widget to help internet users discover content across a network of partner websites.

This document is intended for end users of the Widget and the trendmd.org website, and is distinct from TrendMD’s separate Terms of Service ("TOS") for TrendMD clients who opt to use TrendMD’s services. By accessing or using the Widget, the trendmd.org website, and any content or service provided through them, you acknowledge that you have read, understood, and agree to be bound by these Use Terms.

If you do not agree with these Use Terms, do not use the Widget, the trendmd.org website, or any content recommendations provided through them.

For the purposes of these Use Terms, the following definitions apply:

User (or “you”): An individual internet user who views, clicks, or otherwise interacts with content promoted via the TrendMD Widget. This includes readers on third-party websites that feature the Widget.

Company (or “TrendMD” or “we”): TrendMD LLC, including its successors, subsidiaries, and affiliates. This is the provider and operator of the Widget and related recommendation services.

Widget: TrendMD’s proprietary content recommendation module or interface embedded on partner websites. The Widget displays links, recommendations, or promotional content (collectively, “Promoted Content”) to Users based on TrendMD’s content recommendation technology.

Service: The content recommendation service provided by TrendMD through its Widget and any related technologies, features, or websites. This includes TrendMD’s algorithms, software, and network that deliver Promoted Content to Users globally.

Promoted Content (“Content”): Articles, blog posts, research papers, advertisements, or other informational content that are suggested to Users via the Widget. This Content is typically hosted on third-party sites (our publishing partners or advertisers) and is not owned by TrendMD.

Purpose: These User Terms are a legally binding agreement between you (the User) and TrendMD regarding your viewing and use of content through the TrendMD Widget and the trendmd.org website. The purpose is to outline your rights and responsibilities as an end user, and to ensure you use the Widget and the trendmd.org website in a lawful and appropriate manner.

Scope: These User Terms apply only to end users who interact with the Widget and the trendmd.org website. They do not govern the contractual relationship with TrendMD’s paying clients (such as publishers who install the Widget on their sites or advertisers who pay to promote content). If you are a TrendMD client or partner, your use of TrendMD’s services is governed by our separate client Terms of Service (TOS) or Advertiser Terms, which are available on our website. In the event of any conflict between these end-user Terms and TrendMD’s client TOS, the client TOS will apply to the client’s use of the Service, while these User Terms will continue to govern end users’ behavior and access.

By using the Widget and the trendmd.org website, you also agree to abide by any applicable Privacy Policy and Content Guidelines referenced herein. The Privacy Policy explains how TrendMD collects and handles data (see Section 6 below), and the Content Guidelines (if any) outline what content is permissible to be promoted. These User Terms, the Privacy Policy, and any other referenced documents together form the complete agreement governing your use of the Widget and the trendmd.org website.

The TrendMD Widget appears on websites and helps users discover recommended content.

Users do not need to create an account to access Widget recommendations.

Clicking a recommended link will redirect you to a third-party website.

The Widget is available globally with no geographical restrictions.

Users must not:

Manipulate or tamper with the Widget’s recommendations.

Use automated bots, scripts, or fraudulent means to generate false engagement.

Attempt to reverse-engineer or modify the Widget’s technology.

Violate any applicable laws, including copyright or privacy regulations.

Engage in harmful or misleading activity, such as sharing false information.

Disrupt, overload, or interfere with TrendMD’s technology or network.

TrendMD reserves the right to block access to the Widget for any User violating these User Terms.

TrendMD owns all intellectual property related to the Widget, its software, and algorithms.

Users have no right to copy, modify, distribute, or reverse-engineer the Widget.

Third-party content displayed via the Widget belongs to its respective content creators.

Feedback submitted to TrendMD may be used for improving the Service without compensation.

TrendMD may collect usage data (e.g., clicks, browsing activity) to improve recommendations.

No personal data (e.g., names, emails) is collected unless voluntarily provided.

The Privacy Policy explains how TrendMD handles data and complies with laws such as GDPR and CCPA.

Users may opt out of certain data collection mechanisms (e.g., cookies).

The Widget and Service are provided "as is" and "as available" without warranties of any kind.

TrendMD does not guarantee the accuracy, reliability, or legality of Promoted Content.

TrendMD does not endorse any content recommendations appearing in the Widget.

Users access and interact with content at their own risk.

To the fullest extent permitted by law, TrendMD:

Is not responsible for third-party content accessed via the Widget.

Will not be liable for any damages arising from use of the Widget.

Limits its total liability to USD $100 for any direct damages.

Clicking on recommended content redirects Users to third-party websites.

TrendMD does not control third-party websites or their privacy practices.

TrendMD is not responsible for the security, accuracy, or reliability of external content.

TrendMD may modify, suspend, or discontinue the Widget at any time.

Users will be notified of updates via the website, not by email.

TrendMD may block access to Users who violate these User Terms.

These User Terms are governed by the laws of Delaware, USA.

Users agree that any disputes will be resolved exclusively in Delaware courts.

TrendMD may offer arbitration at its discretion.

Class action lawsuits are waived to the fullest extent permitted by law.
